Protection Orders
Protection orders are issued by the court when requested by a party and the party can demonstrate to the court that an imminent danger exists to the person seeking the protection order. Initially the protection order is issued after hearing only from the party seeking the protection order. If the court finds that an imminent danger does exist to the party requesting the protection order, the court will issue a Temporary Protection Order and will set the matter for hearing. At the hearing, the party who is restrained will have an opportunity to defend himself/herself and present evidence why the protection order is not warranted. If after hearing the court finds that the restrained party did commit acts that constitute grounds to issue a civil protection order and finds that the acts will continue unless the party is restrained, the court will make the Temporary Protection Order permanent.
A protection order is serious and can have long-term consequences. If you have been served with a protection order, our advice is that you get legal counsel. Among other things, a protection order that is issued against you may interfere with your current employment, future employment, and ability to secure future housing. Additionally, a protection order may require that you vacate the marital home and may restrict the time or the manner in which you are able to parent your child(ren). If the protection order is made permanent against you, you will have to wait four years before you can petition the court to have the protection order modified or dismissed.
Additionally, violating the conditions of your protection order is a criminal offense in which you may serve a jail sentence. Thus, do not guess at the meaning of the provisions of the protection order.
